Debt Review Awards Process & Website Terms & Conditions

(Incl SA’s Favourite)

The (1) Debt Review Awards Industry Peer Review Process & (2) SA’s Favourite (public voting) are 2 separate events which are organised and managed by Debtfree Magazine (Leigh King Admin Services cc) and will hereafter be referred to as ‘the Awards’ ‘SA’s Favourite’ or ‘Debt Review Awards’ or Debtfree interchangeably. The Awards process makes use of an online survey or peer review system. The two terms are used interchangeably.

The Debt Review Awards consists in the main of an online peer review resulting in winners of golden piggys in several categories. The peer review is taken among NCR registered parties (not members of the public in general).

SA’s Favourite (held separately and at a different time of year from the Peer review based Debt Review Awards) is, in essence, an online popularity competition where candidates invite members of the public (incl those in the industry) to vote for them in regard to their debt review offerings (specifically) not other aspects of their business. The voting is open to any who follow the registration process and not only NCR registered parties.

General Terms and Conditions

  1. Participation

By participating in the peer review of the Awards process and or SA’s Favourite, each participant agrees to be bound by the official process rules.  Participation is limited to one contribution (in the various categories) per verified email address or representative of a NCR registrant (for the Debt Review Awards) and one vote in the various categories for SA’s Favourite.  If an entrant receives multiple and/or irregular votes or multiple votes from the same user or users, including but not limited to, votes generated by a robotic, programmed, script, macro, other automated means or other source,  the Awards reserves the right to disqualify the participant (ignore the votes) or candidate at its sole discretion. Persons who violate any rule, gain an unfair advantage in participating in the peer review, or obtain winner status using fraudulent means will be disqualified. If any candidate is found to be soliciting votes in return for a purchase or payment of any kind, that candidate may be disqualified at the Awards sole discretion. Anomalies will be considered and if necessary either removed or results adjusted to offset any untoward voting, ratings or inclusion in a particular category. This will be at the discretion of the organisers (see below)

No promoting/advertising like: Vote for us as SA’s Favourite and you could win x.

  1. Submissions, candidates and inclusion/exclusion

In its sole, full and unfettered discretion, the Awards may include or exclude an industry party from the Awards peer review or survey process whether via nomination or signing up to be considered. Should you wish to be considered you can contact awards@debtfreedigi.co.za in advance of the process for possible inclusion at the discretion of the organisers. Top 10, Top 5 nominees and winners in the Debt Review Awards process will be based on the outcome of the peer review or survey process including steps leading up to the peer review. This includes the consultation and series of reviews throughout the year leading up to the final rounds of the review. In the case of a tiebreaker, the final adjudication of the organisers will be in accordance as far as possible with category requirements and criteria at their sole, full and unfettered discretion (see below).

Winners in SA’s Favourite will be based on the highest number of unique votes cast in the particular category. In the case of a tiebreaker the final adjudication of the organisers, in accordance with category requirements and criteria.

In the unlikely event of a results tie, the candidates involved in the tie will be reviewed by the organizers who will serve as a tiebreaker and who will evaluate candidates according to the closest match to the criteria. The decision will be final and binding on all matters relating to such a tie. The peer review or public survey process results will be audited by independent auditors and verified. The results of the peer review process will be final and binding on participants and those considered. Participants agree to abide by the outcome of the system. No negotiations will be entered into in regard to the outcome of the Awards process. The results as determined by the peer review or survey system are binding on participants. For the annual Debt Review Awards, the Top 10 or Top 5 nominee results may be announced in advance of the gala event and the winners announced on the evening of the Awards gala. For SA’s Favourite, the results will be announced online and the winners notified electronically.

  1. Use of material appearing on the Awards website or promotional material

For the purposes of these terms and conditions “material” means material including, without limitation, text, video, graphics and sound material, published on the Awards website, whether copyright of the Awards, Leigh King Admin Services cc or a third party.

You may download and print extracts from the material and make copies of these for your own personal and non-commercial use only. You are not allowed to download or print the material, or extracts from it, in a systematic or regular manner or otherwise so as to create a database in electronic or paper form comprising all or part of the material appearing on the Awards website.  You must not reproduce any part of the Awards website or the material or transmit it to or store it in any other website or disseminate any part of the material in any other form unless we have indicated that you may do so. This also relates to the Awards logo, Top 5 logo and Winner logos for use by candidates who are Top 5 nominees or category Winners. Top 5 and Debt Review Awards Winners will be allowed to refer to the fact that they are Top 5 nominees or Awards Winners and use the Awards logo in their own publicity materials for a period of 3 years from the date on which they receive their award or nomination. Candidates who are not nominated for a top 5 position or winner in a category are not allowed to use their candidature in the process or to use the Awards logo to promote their business unless with specific written consent. Winners in SA’s Favourite will be allowed to refer to themselves as winners and display unique branding supplied by the organisers (for a period of up to 3 years as long as the year is displayed alongside any reference to winning. Eg. SA’s Favourite Debt Counsellor – Western Cape 2018). We may be prepared to allow you to distribute or reproduce other parts of the Awards website or the promotional material in certain circumstances. Please email awards@debtfreedigi.co.za if you wish to apply for permission to do so.

  1. Disclaimer of liability

To the extent permitted by law, we do not accept any responsibility for any statement in the material. You must not rely on any statement we have published on the Awards website or promotional without first taking specialist professional advice. Nothing in the material is provided for any specific purpose or at the request of any particular person. For the avoidance of confusion, we will not be liable for any loss caused as a result of your doing, or not doing, anything as a result of viewing, reading or listening to the material or any part of it (except for death or personal injury attributable to our specific negligence and to the extent permitted at law).

There are links on the Awards website to third party websites which the Awards has no control over. The Awards accepts no responsibility or liability for any third party practices on third party websites. We give no warranties of any kind concerning the Awards website or the material. In particular, we do not warrant that the Awards website or survey portal or any of its contents is virus free. You must take your own precautions in this respect as we accept no responsibility for any infection by virus or other contamination or by anything which has destructive properties.

The entrants acknowledge that the Awards gala and workshop events are organised by the Awards but that catering and the event venue is provided by a business or businesses unconnected with the Awards. The Awards, therefore, accepts no liability in respect of issues arising with catering or venue and all such claims shall be directed at the relevant business.  If for any reason the Awards decides to make material changes to or cancels the event due to unforeseen circumstances, the Awards are not responsible in any event for any expenses incurred by participants, including but not limited to airfare, travel, accommodation or other costs.

  1. Third party material on the Awards website, promotional material or at the Gala event.

You will see advertising material submitted by third parties on the Awards website. Individual advertisers are solely responsible for the content of advertising material which they submit to us, including ensuring that it complies with relevant legislation. We accept no responsibility for the content of any process advertising material, including, without limitation, any error, omission or inaccuracy therein.

 

  1. Obligations of those participating in the peer review or survey process

Those participating should be authorised to represent their firm, company or body in the process. Participants are to endeavour to capture information that reflects their experience with the candidates in a factual manner. Participants are not to accept any compensation from any candidate in return for favourable ratings. Participants consent to being considered themselves in the process. Participants agree to have some of their submissions data shared with some 3rd parties, at the discretion of the organizers,  in regard to reporting following the event. Discretion will be exercised by the organizers in regards to anonymity where practical and possible.

 

  1. Indemnity

The participant shall unreservedly and promptly indemnify and keep indemnified in full the Awards from and against any and all loss, damages, fees (including legal fees and costs incurred), liabilities whether criminal or civil suffered by Leigh King Admin Services cc or a member as a result of any or all of the following: misrepresentation by a candidate; infringement upon intellectual property rights, transmittal of private information, manipulation of the review system by a participant or candidate, failure of the online peer review computer system or programme.

 

  1. Privacy Statement

The Awards respects the privacy of every individual who visits the Awards website or makes use of our online peer review or SA’s Favourite survey system. As part of the registration process, we may collect your email address to send you information pertinent to the Awards including follow up surveys related to the process or industry or links to the Debtfree magazine. By indicating your willingness to be considered and enter review information in regard to candidates you give permission for the PDAs or related industry parties or industry associations to share general (none number specific) information with the organizers which may include contact information, general category confirmation, current standing, etc. You also give permission for selected parties to receive information in regard to their performance in the peer review. This is in line with PoPI requirements. Such information may also be discussed by a closed panel or the organizers especially in the case of a results tie. The Awards will not generally disclose any personal information or contact details that you submit on our website or surveys to any third parties without consent (eg your email address) other than in circumstances as set out above. However, if you do not wish to be contacted, when contacting you we will provide the option of unsubscribing from our database and lists.

 

  1. Governing Law & Jurisdiction

This agreement is governed by South African law and the parties agree to submit to the exclusive jurisdiction of the South African courts.

 

  1. Variations

These terms may be varied from time to time. Please ensure that you review these terms and conditions regularly as you will be deemed to have accepted a variation if you continue to use the site, survey or peer review system after it has been posted.
